Affiliate agreement
Version 2026-11-01.2 · Last updated 1 November 2026 (first-month commission and automatic PayPal payouts)
This agreement is between The Trustee for The Two Watts Trust, ABN 22 639 050 213, trading as The AI King ("we", "us"), and you, the person or business applying to the AI King affiliate programme ("you"). You accept it by ticking the box when you apply or set your password. If you don't agree, don't apply or promote The AI King.
1. Joining the programme
- Applications are reviewed by us. We may approve, decline, suspend or close any affiliate account at our discretion.
- You must be at least 18, give true details, and keep your login secure. You are responsible for anything done with your account.
- You are an independent contractor. Nothing in this agreement makes you our employee, agent, partner or franchisee. You can't make promises, sign contracts or accept payments on our behalf.
2. Your links and tracking
- You get a referral link (for example
theaiking.com.au/?ref=YOURCODEortheaiking.com.au/r/YOURCODE) and can add sub-IDs or campaign tags. - When someone clicks your link we set a first-party cookie on their browser for 60 days. If they click another affiliate's link later, the latest click counts ("last click").
- Visitors from your link may see a tracking phone number. Calls to it go to the same AI King sales line and are credited to you.
- A referral is credited to you only if our system records it through your link, your tracking number, or a "call me" request made after clicking your link. Our records are final unless there is an obvious error. We filter bots and duplicate clicks.
3. How you must promote us
- No spam. No unsolicited emails, texts, calls or messages, and nothing that breaches the Spam Act 2003, the Do Not Call Register Act 2006 or the telemarketing rules. No buying or using contact lists to promote us.
- No misleading claims. Only describe The AI King accurately, using the prices, features and terms on theaiking.com.au. Don't promise results, discounts, free trials or features we don't offer. Follow the Australian Consumer Law.
- Compliant ads only. Your ads must follow the rules of the platform you use (Meta, Google, TikTok and so on) and say clearly that they're from you, an affiliate, where the platform or law requires it.
- No brand bidding. Don't bid on "The AI King", "AI King", "theaiking", our domain names, misspellings or close variants as search ad keywords, and don't use them in ad text, display URLs, domain names, social handles or app names.
- Don't pretend to be The AI King, use our logo in a way that looks like you are us, or create pages that copy our website.
- No content that is illegal, offensive, defamatory, or that sits next to adult, gambling, hate or pirated material.
- Don't use cookie stuffing, forced clicks, hidden frames, bots, incentives to click, or anything else that creates clicks or sign-ups that aren't genuine.
4. No self-referrals
You can't earn commission on your own account, a business you own or control, your employees, or an account set up to get commission rather than to use the service. We may cancel those referrals and any commission on them.
5. Commission
- Sign-up commission (first month): 25% of everything the referred customer pays us in their first month, counted from the date they sign up to the same date the next month. This includes their plan bill (the Plan A upfront payment or a monthly plan fee) and any call-credit top-ups they buy in that month.
- Ongoing commission: after the first month, 10% of each monthly bill the customer pays for the rest of their contract. A month's "bill" includes the plan fee and any call-credit top-ups the customer pays that month.
- Commission is worked out on money that has settled (cleared) in our account, excluding GST. Nothing is earned on a $0 bill (for example a free trial month), on unpaid, pending or failed payments, or on payments after the customer cancels or their contract ends.
- Commission is "pending" for 30 days after the payment settles, then becomes "approved" if it hasn't been refunded or reversed. Only approved commission is paid out.
- We may withhold or cancel commission while your account is suspended or under review, or if you breach this agreement.
- We can change commission rates for future bills by giving you at least 30 days' notice by email. Changes don't affect commission already earned.
6. Refunds, chargebacks and clawbacks
If a bill we paid commission on is refunded (in full or in part), reversed, or charged back, the commission on it is cancelled. If it was already paid to you, we deduct it from your next PayPal payout(s). If your balance stays negative for 90 days we may ask you to repay it.
7. Payouts
- We pay approved commission automatically by PayPal, to the PayPal email you give us when you sign up (or a new one you change to and confirm in the affiliate portal). You need a PayPal account that can receive payments to that email.
- When: sign-up (first-month) commission is paid every fortnight; ongoing commission is paid monthly, on the first business day of the month (Queensland time).
- Minimum: each payout must be at least A$50. A smaller amount rolls over to the next payout of the same kind.
- Clawbacks (section 6) are deducted from your next payout. We never pay commission while your account is suspended.
- If a PayPal payment fails, is returned, or isn't claimed, it goes back to your balance and we pay it in a later run once your PayPal details are fixed. Each time we pay you, we email you a remittance with the PayPal batch and item references.
- PayPal's own fees and currency conversion (if any) are set by PayPal.
- Prices and commission are in Australian dollars. If you are registered for GST, tell us and give us your ABN; we will handle GST on your commission as the law requires (for example by recipient-created tax invoice if we both agree). If you don't give us an ABN where one is required, we may have to withhold tax from payments.
- You are responsible for your own tax.
8. Privacy
We handle your details and referral tracking data under our privacy policy. In your dashboard you see masked business names and masked caller numbers only, never full customer details. Don't collect personal information about our customers on our behalf.
9. Ending the agreement
Either of us can end this agreement at any time by email. We may suspend or end your account straight away if you breach it. When it ends, you must stop using your links and our brand. Approved commission that isn't affected by a breach will be paid in the next payout run; pending commission becomes payable if it is approved under section 5.
10. Liability
To the extent the law allows, we aren't liable for indirect or consequential loss, and our total liability to you under this agreement is limited to the commission paid or payable to you in the 12 months before the claim. You agree to cover our losses caused by your breach of this agreement or the law. Nothing here excludes rights you have under the Australian Consumer Law that can't be excluded.
11. General
We may update this agreement by giving you 30 days' notice by email; continuing to promote us after that means you accept the update. This agreement is governed by the laws of Queensland, Australia.
